Pitfalls to avoid after buying a property in Spain

That’s it! You’re now a homeowner in Spain.

You’ve signed the deed of sale at the solicitor’s office and you’ve got the keys to your dream home… Congratulations! 🎉

But be careful, it’s not all over yet: there are still plenty of steps to take after the purchase, and it would be risky to overlook them.

🧱 1. Confondre le rôle du notaire espagnol

In Spain, notaries do not perform the same functions as they do in France, Belgium or Switzerland. They do not declare or pay the taxes associated with the purchase, such as:

  • The ITP (Inheritance and Gift Tax) for the former,
  • VAT (IVA) and AJD (stamp duty) on new properties.

These formalities are the responsibility of the buyer or their legal representative (solicitor, estate agent, etc.). You have 30 calendar days from the date of signing to complete them.

2. Ne pas faire immédiatement les changements de titularité (eau, électricité, gaz)

As soon as you know the date of signing, ask the sellers or the estate agent for the latest contracts. This allows you to:

  • Changes the name of the new owner
  • Avoid any cuts,
  • Claim your share of the drinks from the seller

🔑 3. Ne pas revisiter le bien juste avant ou juste après la signature

It is essential to view the property 24 hours or a few hours before signing the contract at the solicitor’s office , in order to check that:

  • No furniture has gone missing,
  • No damage occurred.

🔐 4. Ne pas changer les serrures

Even if the seller gives you all the keys, it’s impossible to know how many copies have been made.

Got some work planned? Don’t leave it unattended.

  • Compare quotes from several local companies (at least three),
  • Set deadlines and late payment penalties in the contract,
  • For major works, apply for a licencia de obras (building permit) and obtain the consent of the owners’ association.

Check it always :

  • The materials,
  • The facilities,
  • Public areas,

And compare them with the “memoria de calidades”, a legal and contractual document provided by the developer/builder

🛡️ 7. Ne pas souscrire une assurance habitation immédiatement

The insurance must be in force from the moment the contract is signed at the solicitor’s office. It covers:

  • Water damage,
  • The theft,
  • The fire…

🧑⚖️ 8. Ne pas assister aux réunions de copropriété

Even if you are not a permanent resident, you have the right to vote and must abide by the building’s decisions.

📜 9. Oublier l’autorisation de la copropriété pour la location touristique

In certain regions (Catalonia, the Balearic Islands, Andalusia, etc.), the owners’ association may prohibit or restrict holiday rentals.

  • Check the internal rules regarding holidays rentals
  • Check the local rules
  • Obtain written authorisation if necessary.

This document proves your legal ownership of the property. It is essential for:

  • To sell
  • To get a mortgage
  • Or any dispute.

You should comunicate your new address in Spain to :

🌍 16. Ne pas déclarer vos revenus espagnols dans votre pays de résidence

All your income (including that received in Spain) must be declared in your country of tax residence, in accordance with international tax treaties.

📆 17. Sous-estimer la gestion de la location touristique

To rent a property in Spain by week of monthly needs :

  • An official registration
  • On-site management (cleaning, check-in/out…),
  • A tax declaration

👉 Don’t underestimate the workload, especially when working remotely.

🛑 18. Ne pas souscrire une assurance contre les impayés locatifs

If you plan to rent a property in Sapin for a long term , It will be recomanded to ask for an insurance to avoid non paiments

💸 19. Take into account the plus value fees

Once you are goint to sell , you will need to pay

  • Plus value local tax
  • La plusvalía municipal (impôt local),
  • The agency fees if you sell by a real estate
  • The oficial documents as ITE , energy certificate
